1. Introduction

Welcome to Consultify. These Terms of Service ("Terms") govern your use of our Meta advertising services, AI-powered appointment setting solutions, and related marketing technologies. By engaging our services, you agree to be bound by these Terms.

Consultify ("we," "our," or "us") provides end-to-end Meta Ads management, conversion funnel development, and AI-driven lead follow-up services designed to help businesses generate qualified appointments and maximize return on ad spend.

2. Service Scope

Our services include, but are not limited to:

  • Meta Ads campaign strategy, creation, and management across Facebook, Instagram, Messenger, and WhatsApp
  • Custom conversion funnel design and development
  • Conversions API (CAPI) and Meta Pixel implementation
  • AI-powered appointment setting and lead qualification agents
  • Real-time performance dashboards and reporting
  • Weekly strategy consultations and campaign optimization

The specific scope of services will be outlined in your individual service agreement or proposal document. Any services not explicitly included require separate agreement.

3. Payment Terms

Management Fees: Our management fees are billed monthly in advance. Payment is due within 7 days of invoice date. We accept major credit cards, ACH transfers, and wire transfers.

Ad Spend: Advertising spend is billed directly by Meta through your connected Business Manager account. You are responsible for maintaining valid payment methods with Meta and ensuring sufficient funds for your agreed ad spend levels.

Setup Fees: One-time setup fees for funnel development, CAPI integration, and AI agent configuration are due upon project commencement.

Late Payments: Accounts past due by more than 14 days may result in campaign pausing. Accounts past due by more than 30 days may be subject to service termination.

4. Client Obligations

As our client, you agree to:

  • Provide timely access to your Meta Business Manager, ad accounts, and relevant platforms
  • Respond to approval requests within 48 business hours to avoid campaign delays
  • Provide accurate business information for ad creative and landing page development
  • Maintain compliance with Meta's advertising policies and community standards
  • Ensure you have legal rights to all materials, images, and content provided to us
  • Notify us promptly of any changes to your business, services, or target audience
  • Attend scheduled strategy calls or provide 24-hour advance notice for rescheduling

5. Performance and Guarantees

While we employ industry best practices and proven methodologies, advertising performance is influenced by numerous factors outside our control, including market conditions, competition, seasonality, and platform algorithm changes.

We do not guarantee specific results, including but not limited to: number of leads, appointments, sales, ROAS figures, or revenue outcomes. Past performance and case studies are illustrative and do not guarantee future results.

6. Intellectual Property

Client Materials: You retain all rights to your brand assets, logos, and proprietary content provided to us.

Deliverables: Upon full payment, you own all custom landing pages, funnels, and ad creatives created specifically for your campaigns.

Our Systems: Consultify retains ownership of our proprietary methodologies, AI training data, automation workflows, and internal tools.

7. Termination

Either party may terminate the service agreement with 30 days written notice. Upon termination, you will receive access to all campaign assets, landing pages, and data within your accounts.

We reserve the right to terminate services immediately if you breach these Terms, engage in fraudulent activity, or violate Meta's advertising policies in ways that jeopardize our agency standing.

8. Limitation of Liability

To the maximum extent permitted by law, Consultify's total liability for any claims arising from our services shall not exceed the total fees paid by you in the three months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost revenue, or business interruption.

1. Introduction

Consultify is committed to protecting the privacy of our clients and their customers. This Privacy Policy explains how we collect, use, store, and protect personal information in connection with our Meta advertising and AI appointment-setting services.

2. Information We Collect

Client Information: We collect business contact information, billing details, and account credentials necessary to provide our services.

Lead Data via Meta Pixel and CAPI: Through Meta Pixel and Conversions API integrations on your funnels, we collect:

  • Contact information submitted through lead forms (name, email, phone number)
  • Website behavior data (page views, button clicks, scroll depth, time on page)
  • Conversion events (form submissions, appointment bookings, purchases)
  • Device information (browser type, operating system, device identifiers)
  • IP addresses and approximate geographic location

AI Bot Interaction Logs: Our AI appointment-setting agents collect and store:

  • Complete conversation transcripts between leads and AI agents
  • Lead responses to qualification questions
  • Appointment scheduling preferences and confirmed bookings
  • Interaction timestamps and response patterns
  • Channel of communication (SMS, Messenger, Instagram DM, WhatsApp)

3. How We Use Information

We use collected information to:

  • Optimize Meta ad campaigns and improve targeting accuracy
  • Train and improve AI agent responses and qualification accuracy
  • Provide performance reporting and analytics dashboards
  • Send conversion data to Meta for attribution and optimization
  • Schedule and confirm appointments on behalf of our clients
  • Comply with legal obligations and resolve disputes

4. Data Sharing

We share data with:

  • Meta Platforms: Conversion events and customer information for ad optimization via CAPI
  • Our Clients: All lead data and conversation logs are accessible to the client whose campaigns generated them
  • Service Providers: Hosting providers, CRM platforms, and calendar services necessary for service delivery
  • Legal Requirements: When required by law, court order, or government regulation

We do not sell personal information to third parties for their marketing purposes.

5. Data Retention

Lead data and conversation logs are retained for 24 months from collection date, unless longer retention is required by law or requested by the client. Clients may request earlier deletion of specific data upon written request.

After service termination, we retain data for 90 days to facilitate transition, after which it is securely deleted unless otherwise agreed.

6. Data Security

We implement industry-standard security measures including:

  • 256-bit SSL/TLS encryption for all data transmission
  • Encrypted data storage at rest
  • Multi-factor authentication for all team access
  • Regular security audits and vulnerability assessments
  • Limited access controls based on role requirements

7. Your Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or port your personal data. To exercise these rights, contact us at privacy@consultify.io.

For leads whose data we process on behalf of clients, please contact the business whose ad or funnel you interacted with directly.

8. International Transfers

Data may be processed in the United States and other countries where our service providers operate. We ensure appropriate safeguards are in place for international data transfers in compliance with applicable data protection laws.

Each third party has their own privacy and cookie policies governing their data practices.

5. Cookie Duration

Session Cookies: Deleted when you close your browser.

Persistent Cookies: Remain for a set period:
